2. Operators at the venue
The venue at Rua de Pinto Bessa hosts more than one independent economic operator. This distinction determines who is contractually responsible to the customer in each case:
- Contorno Líquido – Lda is responsible for the brewery, the beers and other beverages served or sold, the beergarden, the events it organises and this website.
- Pitadamaravilha, Lda., NIPC 510780784, with registered office at Praça 9 de Abril, 201, 6Dt, 4200-422 Porto, operating under the Sandwitch brand, is an independent operator responsible for the food service at the venue, including the preparation of food, allergen information relating to its products, its own invoicing and its own Complaints Book.
Each operator is solely responsible for its own products, services, invoicing and legal obligations. Contorno Líquido – Lda assumes no responsibility for contracts concluded between the customer and the food operator, and vice versa. The invoice issued for each transaction identifies the responsible operator.
3. Purpose and scope
These terms govern access to and use of the website dosdiabos.pt, orders placed through it, and the general conditions applicable to the services provided by the Company at its establishment, namely the brewery, taproom, beverage service, beergarden and events.
By accessing or using this website you declare that you have read and accept these terms. If you do not agree with them, you should not use the website.
These terms do not affect any mandatory consumer rights under Portuguese and European Union law, in particular Law no. 24/96 of 31 July (Consumer Protection Law), Decree-Law no. 24/2014 of 14 February and Decree-Law no. 84/2021 of 18 October, which prevail over any conflicting provision below.
4. Website content and availability
Content on this website is provided in good faith and for general information and promotional purposes. References to beers, food, opening hours, events and bookings are indicative and subject to change according to operational availability. Product pages in the online shop are binding as to price and description at the moment an order is confirmed, subject to clause 11.
The Company may update, correct, suspend or remove content at any time, and does not guarantee that the website will be permanently available, uninterrupted or free of technical errors.
5. Lawful use of the website
You agree to use this website lawfully and responsibly. In particular, you must not:
- interfere with the normal operation, security, integrity or accessibility of the website;
- introduce viruses, malicious code or any element capable of causing damage;
- attempt to obtain unauthorised access to systems, servers, orders or accounts;
- use the website for fraudulent, misleading or otherwise unlawful purposes;
- place orders using false identification or another person's payment means;
- carry out automated collection of content or data without prior written authorisation.
6. Age restriction and alcohol notice
Under Decree-Law no. 106/2015 of 16 June, the sale and provision of alcoholic beverages to persons under 18 years of age is prohibited, as is the sale and provision of alcoholic beverages to persons who are visibly intoxicated or who show apparent psychological impairment.
By placing an order for alcoholic products you declare that you are at least 18 years of age. The Company may request proof of age at the establishment, at the time of order and at the time of delivery, and may refuse service or delivery where age cannot be verified. In such cases the order may be cancelled and the amount paid refunded, without prejudice to any return costs attributable to the customer.
This website is not intended to encourage the purchase or consumption of alcoholic beverages by minors, nor to associate alcohol consumption with physical performance, driving, professional or social success, or therapeutic properties, in accordance with Article 17 of the Advertising Code (Decree-Law no. 330/90 of 23 October).
Alcohol should be consumed responsibly. Nothing on this website constitutes medical, nutritional or health advice. Do not drink and drive.
7. Access to the establishment and house rules
Access is subject to available capacity and to compliance with the applicable rules of operation, safety and public order. The Company may refuse or terminate access, without refund, in cases of aggressive behaviour, harassment, discrimination, damage to property, unlawful conduct or non-compliance with staff instructions, always on objective and non-discriminatory grounds.
Smoking is prohibited in enclosed areas in accordance with Law no. 37/2007 of 14 August, as amended.
Outdoor areas, including the beergarden, operate within the noise limits and opening hours authorised by the competent municipal authorities. Customers are asked to respect the surrounding neighbourhood, particularly at night.
Animals are admitted only under the conditions indicated at the establishment. Assistance dogs are always admitted, under Decree-Law no. 74/2007 of 27 March.
8. Bookings
Table, group or space bookings are only confirmed once expressly accepted by the Company through the channel indicated at the time of the request. Requests submitted through forms, e-mail, telephone or social media do not constitute a confirmed booking until such acceptance.
Where a deposit or minimum spend applies to groups or private events, the applicable terms, including cancellation deadlines, are communicated in writing before payment and form part of the specific contract.
Tables may be held for a tolerance period, after which the booking may be released. Cancellations should be communicated as early as possible.
9. Events and tickets
Programmed events may be changed, postponed or cancelled for reasons of force majeure, safety, insufficient attendance or unavailability of artists. Where an event is cancelled by the Company, the ticket price is refunded. Where an event is postponed, tickets remain valid for the new date and the holder may alternatively request a refund within the period announced.
Tickets are personal and must be presented at the entrance in valid form. Access remains subject to clauses 6 and 7.
Where tickets are sold through a third-party ticketing platform, the contract for the ticket purchase is concluded with that platform and governed by its own terms, without prejudice to the Company's obligations as event organiser.
10. Food information and allergens
Information on ingredients and on the substances or products causing allergies or intolerances listed in Annex II to Regulation (EU) no. 1169/2011 is available at the establishment on request, in accordance with Decree-Law no. 26/2016 of 9 June.
For food served at the venue, this information is provided by the food operator identified in clause 2, which is responsible for its accuracy. For beers and other beverages supplied by the Company, allergen and ingredient information is provided by the Company, on the label in the case of packaged products.
Any menu or ingredient information published on this website is indicative and may not reflect recipe changes, seasonal variations or supplier substitutions. Customers with allergies or intolerances should always inform staff before ordering. Products are prepared in premises where allergens are handled, so the absence of cross-contamination cannot be guaranteed.
11. Online orders and formation of the contract
Where the online shop is available, the ordering process is as follows: selection of products, review of the basket, entry of billing and delivery details, selection of the delivery or collection method, selection of the payment method, and confirmation of the order. Before final confirmation you are able to identify and correct input errors.
Placing an order constitutes an offer to purchase. The contract is concluded when the Company sends confirmation of acceptance of the order to the e-mail address provided, or, at the latest, when the products are dispatched. Automatic acknowledgement of receipt of the order does not in itself constitute acceptance.
The Company may refuse an order where the product is unavailable, where payment is not authorised, where the age requirement in clause 6 is not met, or where there are objective grounds to suspect fraudulent use. In such cases any amount charged is refunded.
Prices are expressed in euros and include VAT at the legally applicable rate. Delivery costs, delivery methods, delivery times, accepted payment methods and any additional charges are shown before the order is confirmed and form part of the contract. An invoice is issued for every transaction under the applicable tax legislation; where the invoice is to include a tax identification number, it must be provided before the order is completed.
The publication of a price resulting from an obvious error does not bind the Company, which will inform the customer as soon as such an error is detected and offer the option to confirm the order at the correct price or cancel it with a full refund.
The contract is concluded in Portuguese or English, as applicable, and the Company files the record of the order, which may be requested by the customer using the contacts in clause 1.
12. Delivery and collection
Unless a different period is indicated at the time of the order, products are delivered without undue delay and no later than 30 days from the conclusion of the contract, in accordance with Article 18 of Decree-Law no. 24/2014.
Where alcoholic products are delivered, proof of age may be required at the moment of delivery. Delivery will not be made to a person who cannot demonstrate being at least 18 years of age, and the order may be returned at the customer's cost.
The risk of loss of or damage to the goods passes to the consumer upon physical delivery to the consumer or to a carrier chosen by the consumer.
For orders collected at the establishment, collection must take place within the period indicated in the order confirmation and during the venue's opening hours.
13. Right of withdrawal
Where the consumer purchases at a distance or off-premises, the consumer has the right to withdraw from the contract within 14 days without giving any reason, under Decree-Law no. 24/2014 of 14 February.
The period runs from the day the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods, or from the conclusion of the contract in the case of services. To exercise the right, the consumer must inform the Company of the decision by an unequivocal statement, using the contacts in clause 1 or the model form annexed to these terms, before the period expires.
The consumer must return the goods without undue delay and no later than 14 days after communicating the withdrawal, and bears the direct cost of return unless otherwise agreed. The Company reimburses all payments received, including the standard delivery cost, without undue delay and no later than 14 days after being informed, and may withhold reimbursement until it has received the goods back or the consumer has supplied evidence of having sent them. The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
Under Article 17(1) of that Decree-Law, the right of withdrawal does not apply, among other cases, to:
- the supply of food, beverages or other goods intended for current consumption in the household, physically delivered by the trader on frequent and regular rounds;
- the provision of catering, leisure, accommodation or transport services where the contract provides for a specific date or period of performance, which covers table bookings and tickets for events on a set date;
- goods made to the consumer's specifications or clearly personalised;
- sealed goods which are not suitable for return for health protection or hygiene reasons, once unsealed after delivery;
- goods which are liable to deteriorate or expire rapidly;
- goods which, after delivery, are by their nature inseparably mixed with other items.
14. Legal guarantee of conformity
Goods sold to consumers benefit from the legal guarantee of conformity under Decree-Law no. 84/2021 of 18 October. The Company is liable for any lack of conformity existing at the time of delivery and which becomes apparent within three years of delivery of the goods. Any lack of conformity that becomes apparent within two years of delivery is presumed to have existed at that date, unless proven otherwise or unless the presumption is incompatible with the nature of the goods or of the lack of conformity.
In the case of food and beverages, the durability or best-before date indicated on the packaging is relevant to assessing conformity, as is compliance with the storage conditions indicated.
Where there is a lack of conformity, the consumer is entitled, under the conditions set out in that Decree-Law, to the restoration of conformity, to a proportionate reduction of the price or to termination of the contract. Claims may be submitted using the contacts in clause 1.
15. Intellectual property
Unless otherwise stated, all content on this website, including texts, trade marks, logos, graphics, photographs, illustrations, videos, layout elements, source code and product designations, is protected by copyright and industrial property rights and belongs to the Company or to third parties who have authorised its use.
Copying, reproduction, distribution, public communication, transformation or any other use of such content is prohibited without prior written authorisation from the respective rights holder, except for uses permitted by law. Editorial and journalistic use of press materials expressly made available for that purpose is permitted, with attribution.
16. Photography and audiovisual recording
Photographic and audiovisual recordings may be made at the venue during events, for the purposes of documenting and promoting the Company's activity. Where such recordings allow individuals to be identified, they involve the processing of personal data under Regulation (EU) 2016/679 (GDPR) and Law no. 58/2019 of 8 August.
Signage indicating recording is displayed at the relevant locations. Any person may object to the use of images in which they are identifiable, or request their removal, using the contacts set out in the Privacy Policy.
Content sent to the Company by users, including images shared on social media using the Company's tags or hashtags, may be republished on the Company's own channels with attribution, unless the author objects.
17. External links and third-party services
This website may contain links to third-party websites, social media pages, booking platforms, ticketing services, payment providers or map services. The Company does not control and is not responsible for the content, availability, security or privacy practices of those third parties. The inclusion of a link does not imply association, endorsement or recommendation.
18. Liability
The Company is liable under the general law for damage caused to customers by its own conduct. It does not exclude or limit liability for death or personal injury, for wilful misconduct or gross negligence, or any liability that cannot be excluded under mandatory consumer legislation.
To the maximum extent permitted by law, the Company is not liable for indirect or consequential damage arising from use of, or inability to use, this website, nor for interruptions caused by technical failures beyond its reasonable control.
Customers are responsible for their personal belongings at the venue.
19. Privacy and cookies
Use of this website involves essential technical storage or cookies required for core functionality, and may involve additional tools subject to consent under Article 5 of Law no. 41/2004 of 18 August.
Information on the processing of personal data, legal bases, retention periods, recipients and the exercise of data subject rights is set out in the Privacy Policy.
20. Complaints and consumer dispute resolution
Complaints may be addressed directly to the Company using the contacts in clause 1, and are answered within the legally applicable deadlines.
Consumers also have access to the electronic Complaints Book under Decree-Law no. 156/2005 of 15 September, available at livroreclamacoes.pt. Complaints concerning food service should be directed to the operator identified in clause 2, which maintains its own Complaints Book.
Under Article 18 of Law no. 144/2015 of 8 September, in the event of a consumer dispute the consumer may resort to the following alternative dispute resolution entities:
- CICAP – Centro de Informação de Consumo e Arbitragem do Porto, Rua Damião de Góis 31, loja 6, 4050-225 Porto | cicap.pt
- CNIACC – Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, of supplementary national jurisdiction | cniacc.pt
The Company is not a member of an alternative dispute resolution entity. The information above is provided in compliance with the legal duty to inform consumers of the entities available to them.
An updated list of registered alternative dispute resolution entities is available from the Direção-Geral do Consumidor at consumidor.gov.pt.
21. Accessibility
The Company aims to keep this website usable by the widest possible range of people, including keyboard navigation and adequate contrast. If you encounter an accessibility barrier, please contact us using the details in clause 1 so that we can address it.
22. Changes to these terms
The Company may update these terms whenever necessary to reflect operational, legal or technical changes. The version published on this page is the version in force, identified by the version number and date at the top. Changes do not have retroactive effect on contracts already concluded, which remain governed by the version in force at the time of conclusion.
23. Severability
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be replaced by one that most closely reflects its purpose within the limits of the law.
24. Applicable law and jurisdiction
These terms are governed by Portuguese law. Any dispute arising from them shall be submitted to the Portuguese courts, without prejudice to the consumer's right to bring proceedings in the court of their domicile and to the mandatory rules of the country of their habitual residence.
